1. Service Provider Identification

This platform presents professional services in business process automation, AI conversational systems, software systems architecture, and specialized Manychat consulting for organizations and business owners.

3. Nature of Estimates and Commercial Proposals

  1. AI Assistant Exploratory Estimates: Any budgets, timelines, or operational ranges provided interactively by the AI assistant are strictly non-binding, preliminary simulations based on user-supplied variables.
  2. Binding Proposals: Formal and legally binding proposals are exclusively issued after a technical discovery meeting, thorough scope validation, and mutual written agreement signed by Rodrigo Silvano.

4. Intellectual Property, Know-How, and Trade Secrets

  1. Exclusive Ownership: All content, operational methodologies, automation blueprints, workflow diagrams, source code, visual UI systems, system prompts, trademarks, and concepts on this website are the sole and exclusive intellectual property of Rodrigo Silvano.
  2. No Reverse Engineering: Any unauthorized reproduction, decompilation, reverse engineering, web scraping, or misappropriation of proprietary automation workflows and concepts demonstrated on this site or in discovery calls is strictly prohibited.
  3. Limited Use License: Visitors are granted a limited, revocable, non-exclusive license to review website content solely for the purpose of evaluating prospective professional engagement.

5. Operational Warranty & Limitation of Liability

  1. 30-Day Operational Warranty: Formally contracted and delivered custom automation systems include a 30-day warranty starting upon operational delivery. This warranty covers the remediation, without extra charge, of bugs or software inconsistencies directly originating from the agreed scope of work.
  2. Third-Party APIs and Platforms: Solutions frequently interface with third-party software (Manychat, Meta/WhatsApp, OpenAI, Stripe, Cal.com). Rodrigo Silvano shall not be held liable for outages, unilateral policy changes, or breaking API deprecations originating from external providers.
  3. Availability: This site and the AI assistant are provided on an "as is" and "as available" basis without guarantees against unexpected downtime or network latency.

7. Artificial Intelligence Agents, Automated Tools & Delegated Transactions

  1. Agency and Representation by Autonomous Systems: Any browsing, interaction with the virtual assistant, pricing inquiry, meeting booking, or data submission performed by Artificial Intelligence agents, autonomous browser agents (computer use, browser agents), tool protocols (Model Context Protocol / WebMCP), or automated scripts operating on behalf of a user is conclusively deemed to be performed under the direct authorization, agency, and civil liability of the individual or legal entity controlling that agent.
  2. Delegated Payments and Financial Transactions: Any purchases, service enrollments, or training purchases (specifically including the Manychat Intensive Course via Stripe checkout) initiated, facilitated, or completed by autonomous AI agents are deemed irrevocably authorized by the lawful holder of the payment method employed.
  3. Exclusion of Repudiation Based on AI Actions: No refund requests, retroactive cancellations, or credit card chargebacks will be accepted under assertions of "unauthorized autonomous AI action", "model hallucination", "agent error", or "unforeseen AI behavior". The account and cardholder maintains exclusive responsibility for safeguarding credentials, setting spending boundaries, and configuring permissions for their autonomous agents.
  4. Fair Use and Infrastructure Integrity: Operating AI agents for denial-of-service attacks (DoS/DDoS), exceeding rate limits, transmitting abusive automated submissions (spam), attempting prompt injection or jailbreaks against the AI assistant, or executing aggressive proprietary scraping is strictly prohibited. Rodrigo Silvano reserves the right to immediately block offending IP addresses, revoke access, and seek compensation for operational damages.

8. Consumer Dispute Resolution & Online Complaints Book

In strict compliance with Portuguese Decree-Law no. 156/2005 and Decree-Law no. 74/2017, this website provides direct access to the official Online Complaints Book, as well as alternative dispute resolution mechanisms under Law no. 144/2015:

9. Governing Law and Jurisdiction

  1. These Terms and Conditions are governed by the laws of the Republic of Portugal.
  2. For any dispute arising between commercial business parties (B2B relationships), the Judicial Court of the District of Guarda, Portugal (Tribunal da Comarca da Guarda) shall have exclusive jurisdiction, with express waiver of any other venue.
